CMA and ICO issue joint statement on cooperation in digital markets

On May 19, 2021, the UK’s national competition authority, the CMA, and its data protection authority, the ICO, published a joint statement seeking to strike a balance between competition law and data protection law in approaching digital markets. The declaration emphasizes the overlapping importance of the protection of personal data and competition in the digital markets and, above all, looks at these problems from the point of view of the consequences that arise in practice.
The statement sets out how the CMA and ICO will work together to find regulatory solutions to tensions in the digital economy. The statement divides the “strong synergies” between the two regulators into three main categories:
- User selection and control;
- Privacy standards and regulations; and
- data-related interventions to promote competition.
More effective protection of privacy is made possible by effective competition in digital markets and regulators are determined to achieve this.
An updated memorandum of understanding signed by the CMA and the ICO supports the joint statement. This explains how the two regulators will work together in the future, for example by exchanging information.
The joint declaration is unique in the world and builds on the work plan of the Digital Co-operation Regulatory Framework (DRCF) for 2021/22.
